मुख्य सूचना आयुक्त ने दिया नगर निगम के अधिकारियों को सूचना अधिकार प्रशिक्षण का आदेश

देहरादून:  उत्तराखंड के मुख्य सूूचना आयुक्त ने नगर निगम के अधिकारियों को सूचना का अधिकार का प्र्रशिक्षण देने का आदेश नगर आयुक्त को दिया है। यह आदेश सूचना अधिकार कार्यकर्ता नदीम उद्दीन एडवोेकेट की अपील पर मुख्य सूचना आयुक्त शत्रुघ्न सिंह द्वारा दिया गया है।

काशीपुर निवासी सूचना अधिकार कार्यकर्ता नदीम उद्दीन एडवोकेट ने काशीपुर नगर निगम के लोक सूचना अधिकारी से भवन कर/सम्पत्ति कर के बकायदारों तथा नगर निगम काशीपुर की सम्पत्तियों के किरायेदारों/आवंटियों पर बकाया धनराशियों की 6 बिन्दुुओं पर सूचना 02 अगस्त 2019 को मांगी थी।

लोक सूचना अधिकारी/कर अधीक्षक नगर निगम ने केवल बकाया की कुल धनराशियों की सूचना उपलब्ध करायी और पांच बिन्दु की सूचना उपलब्ध न होने का बहाना करते हुये नहीं उपलब्ध करायी।

इस पर श्री नदीम ने प्रथम अपील की जिस पर प्रथम अपीलीय अधिकारी/नगर आयुक्त ने सूचना उपलब्ध कराने का आदेश दिया। लेकिन वह इसके आदेश का पालन नहीं कर सके। प्रथम अपील के बाद भी सूचना न उपलब्ध कराये जाने पर उत्तराखंड सूचना आयोग को द्वितीय अपील की गयी।

द्वितीय अपील सं0 31482/20 की सुनवाई आडियो/वीडियो कांफ्रेसिंग के माध्यम से 10 नवम्बर को हुई। मुख्य सूचना आयुक्त डाॅ0 शत्रुघ्न सिंह ने लोक सूचना अधिकारी केे सूचना उपलब्ध न होने के तर्क को सही नहीं माना और शेष बचे पांच बिन्दुओें पर सूचना एकत्र कर 23 नवम्बर तक निः शुल्क उपलब्ध कराने का आदेश दिया। इसके साथ ही लोक प्राधिकारी/नगर आयुक्त को आदेश की प्रति भेजकर सूचना का अधिकार अधिनियम की धारा 4 की व्यवस्था के अनुपालन कराने तथा निगम के लोक सूचना अधिकारियों तथा विभागीय अपील अधिकारियोें को सूचना का अधिकार का प्रशिक्षण दिलाने का आदेश दिया।

मुख्य सूचना आयुक्त शत्रुघ्न सिंह नेे अपने अपील सं0 31482 केे निर्णय में स्पष्ट लिखा है कि सुुनवाई केे दौैरान भी ऐसा महसूस हुआ कि लोक सूचना अधिकारी को सूचना का अधिकार अधिनियम की व्यवस्था के बारे में प्रशिक्षण दिलाया जाना अनिवार्य हैै। यह निर्विवादित हैै कि सूचना का अधिकार अधिनियम की धारा 4 का अनुुपालन लोेक प्राधिकारी द्वारा किया जाना चाहिए।

श्री नदीम नेे बताया कि सूचना का अधिकार अधिनियम की धारा में समस्त अभिलेेख सूचीबद्ध करना, संसाधनों के अधीन कम्प्यूटरीकृत करने तथा जनता को प्रभावित करने वाली नीतियोें व निर्णयों केे कारण उपलब्ध कराना, स्वयं प्रकट करनेे योग्य महत्वपूर्ण सूचनाओं को इंटरनैट आदि के माध्यम सेे स्वयं जनता को बिना मांगे उपलब्ध कराने व इन्हेें वार्षिक/त्रैैमासिक रूप से अपडेेट करने का प्रावधान हैै।

श्री नदीम के अनुसार शासनादेश सं0 2895 दिनांक 26 सितम्बर 2013 के शासनादेश के बाद कुल 27 प्रकार की सूचनायें स्वयं प्रत्येेक लोेक प्राधिकारी/विभाग/निगम को स्वयं प्रकाशित करके वेबसाइट आदि पर उपलब्ध कराना धारा 4(1)(बी) के अन्तर्गत अनिवार्य है।

नगर निगम के लियेे इसमें अधिकारियों के कर्तव्य व अधिकार, कार्य को तय सिद्धांत, निगम, रेगुलेशल, मैनुुअल व रिकार्ड, दस्तावेजोें के प्रकार, बोर्ड परिषद, समितियों का  आवंटित बजट, सब्जिडी कार्यक्रम, रियायतें व परमिट आदि का विवरण, उपलब्ध व कब्जे की सूचनायें, नागरिकों को सूचना प्राप्ति हेतु सुविधायेें, सूचना अधिकारियों का विवरण शामिल हैै।
