महाराष्ट्रः सीबीआई जांच के लिए राज्य सरकार से लेनी होगी सहमति

राज्य सरकार का सीबीआई को दी ‘आम सहमति’ पर वापसी का अदेश

मुंबईः  महाराष्ट्र सरकार ने बीते बुधवार को राज्य के अन्दर होने वाली सीबीआई जाॅंच को लेकर दिल्ली विशेष पुलिस प्रतिष्ठान कानून, 1946 (डीपीएसई एक्ट) के तहत राज्य में शक्तियों और न्यायक्षेत्र के इस्तेमाल की सहमति को वापस लेने संबंधी एक आदेश जारी किया है।

महाराष्ट्र सरकार द्वारा 22 फरवरी 1989 को जारी एक आदेश के तहत सीबीआई को राज्य में शक्तियों और न्यायक्षेत्र के इस्तेमाल के लिए आम सहमति दी गई थी। जिसे बुधवार 21 अक्टूबर 2020 को मौजूदा सरकार द्वारा वपस लेने का आदेश जारी किया गया, जिसके तहत अब किसी भी जाॅच को शुरु करने से पहले सीबीआई को प्रदेश सरकार से सहमति लेनी होगी।

सीबीआई की जाॅंच पर राज्य सरकार की सहमति के आदेश को लेकर महाराष्ट्र से पूर्व पश्चिम बंगाल और राजस्थान जैसे राज्य पहले ही ऐसे कदम उठा चुके हैं। कई राज्यों की सरकारों ने केंद्र पर आरोप लगाया है, कि वे अपने फायदे के लिए सीबीआई का दुरुपयोग कर रहे हैं।

सूत्रों के अनुसार मुंबई पुलिस द्वारा टीआरपी घोटाले का खुलासा होने और अभिनेता सुशांत सिंह राजपूत की आत्महत्या मामले के चलते राज्य सरकार ने यह कदम उठाया है।

बीते छह अक्टूबर को मुंबई पुलिस ने रिपब्लिक टीवी सहित तीन चैनलों पर टीआरपी में हेरफेर करने में शामिल होने का आरोप लगाया था, व उनके खिलाफ प्राथमिकी दर्ज की थी। जिस पर रिपब्लिक टीवी ने बॉम्बे हाई कोर्ट का दरवाजा खटखटाया, जहां उनके वकील हरीश साल्वे ने इस मामले की जाॅंच मुंबई पुलिस के बजाय सीबीआई से कराने की मांग की। तो वहीं केंद्र सरकार और भाजपा दोनों रिपब्लिक की दलीलों का समर्थन करते दिख रहे हैं। और मुंबई पुलिस की कार्रवाई को प्रेस की स्वतंत्रता के लिए खतरा बता रहे हैं!

माना जा रहा है कि महाराष्ट्र सरकार ने इसी के चलते सीबीआई को दी गई आम सहमति वापस ले ली है।

सुशांत सिंह राजपूत मौत के मामले पर भी मुंबई पुलिस पहले से ही जांच कर रही थी। परन्तु बाद में सुशांत सिंह राजपूत के पिता द्वारा पटना में दर्ज कराए गई एक प्राथमिकी के आधार पर यह मामला भी सीबीआई के सुपुर्द कर दिया गया था।

लेकिन अब यदि सीबीआई राज्य में किसी मामले की जांच करना चाहती है, तो उसे सहमति के लिए राज्य सरकार से संपर्क करना होगा। हालांकि राज्य सरकार के इस निर्णय से सीबीआई द्वारा जांच किए जा रहे पूर्व के मामलों पर कोई प्रभाव नहीं पड़ेगा।

इसमें मुख्य बात यह है कि सीबीआई के पास केवल केंद्र सरकार के विभागों और कर्मचारियों पर अधिकार क्षेत्र है, राज्य सरकार के कर्मचारियों या किसी राज्य में हो रहे अपराध से संबंधित मामलों की जांच तभी कर सकती है, जब उस राज्य की सरकार सहमति देती है।

इसके अलावा आम सहमति वापस लेने का मतलब है कि सीबीआई महाराष्ट्र में प्राथमिकी दर्ज नहीं कर सकती है।
